Fair Use:
The Copyright Act says that "fair use...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright." (17 U.S. Code 107 - Limitations on Exclusive Use: Fair Use)
Our site may use content under the right of "Fair Use" to write, produce and make a general expression of:
1. News reporting
2. Scholarship
3. Research
4. Criticism, or
5. Comment
Therefore, information, videos, articles, or other such material may be used on our site in compliance with the allowable exemptions under “Fair Use.” We also believe utilizing the material of others for new works of criticism, new reporting, parody, education, research, or scholarship under the allowance of "Fair Use" is a benefit to the public and falls within our Fair Use rights as a ministry and media production company that creates educational material and reports on current events and news.
Notice: If our work has been produced according to "Fair Use" as stated above then DO NOT make any false claims, false reports, frivolous actions or send a Cease-and-Desists letter for the purposes to harass, or to hinder our work as we reserve our rights under state and/or federal law to take counter-action. Therefore, make sure your claim has legal standing before submitting to us.
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. According to EFF: "One company sent an infringement notification seeking removal of online materials that were protected by the fair use doctrine. The company sending the infringement notification was ordered to pay such costs and attorneys fees under this provision. See http://www.eff.org/cases/online-policy-group-v-diebold. In addition, “in order for a copyright owner to proceed under the DMCA with “a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law,” the owner must evaluate whether the material makes fair use of the copyright.” Lenz v. Universal, 572 F. Supp. 2d 1150, 1155 (2008)"
